Our lawful basis

Under Article 6 of the UK GDPR, the lawful bases we may rely upon include:

  • legitimate interests — where necessary for the appropriate operation and administration of the practice, provided those interests do not override your rights;

  • legal obligation — where we are required to process information to comply with the law; and

  • vital interests — in exceptional circumstances where processing is necessary to protect someone's life.

Where we process information concerning your health, we also require an additional condition under Article 9 UK GDPR. For the provision of clinical care and treatment, we rely upon Article 9(2)(h) – health or social care, together with the relevant provisions of the Data Protection Act 2018.

We are subject to professional duties of confidentiality and only collect health information that is relevant and necessary for your care.

Consent to treatment and data protection

Your consent to clinical assessment or treatment is separate from the lawful basis relied upon for processing your personal information. Where data-protection consent is specifically required for a particular activity, this will be requested separately.

Sharing your information

We do not sell your personal information.

Information may be shared where necessary with organisations that support the operation of the practice, such as clinical record, booking, website or payment providers. These organisations may process information on our behalf and are required to handle it appropriately.

Clinical information will not normally be shared with another healthcare professional or organisation without an appropriate reason for doing so. Information may be disclosed without consent where this is necessary or permitted by law, including certain safeguarding situations, serious risks to safety or legal requirements.

Only information that is necessary and proportionate will be shared.

Clinical records and retention

Clinical records are retained in accordance with applicable legal and professional requirements.

In accordance with current BASRaT Clinical Records Guidance, adult clinical records will generally be retained for 8 years following the last clinical contact and children's records generally until the age of 25. A longer retention period may apply where another legal, professional, safeguarding or medico-legal requirement applies.

Once records are no longer required, they will be securely and irreversibly destroyed or deleted.

Other personal information will only be retained for as long as reasonably necessary for the purpose for which it was collected and to meet applicable legal, regulatory or business requirements.

Keeping your information secure

Appropriate technical and organisational measures are used to protect personal information against unauthorised access, loss, alteration or disclosure.

Clinical records are stored using appropriate electronic systems with access restricted to authorised persons.

Where paper clinical information is temporarily created and subsequently transferred securely to the electronic clinical record, the paper copy may be securely destroyed once the electronic record has been checked for completeness and accuracy.

Your rights

Depending on the circumstances and the lawful basis being relied upon, you may have rights including:

  • access to personal information held about you;

  • correction of inaccurate information;

  • erasure of information in certain circumstances;

  • restriction of processing;

  • objection to certain processing;

  • data portability in certain circumstances; and

  • withdrawal of consent where consent is the lawful basis being relied upon.

Some rights are not absolute and may not apply where information must continue to be retained, including where there is a legal or professional reason for doing so.
